A Seneca County Grand Jury has voted separate indictments against two brothers that arose from the same incident in the Town of Ovid on April 13, 2012.
Travis M. Swett was charged with assault in the second degree (class D felony), criminal possession of a weapon in the third degree (class D felony), and two counts of assault in the third degree (class A misdemeanor). The indictment alleged that Travis Swett caused physical injury to an individual by striking him on the back of the head with a beer bottle, punching him in the face and biting his finger. The indictment also alleged that Travis Swett caused physical injury to a second individual by throwing her down to the floor.

Nathaniel E. Swett was charged with assault in the second degree (class D felony), two counts of criminal possession of a weapon in the third degree (class D felony) and assault in the third degree (class A misdemeanor). The indictment alleged that Nathaniel Swett caused physical injury to an individual by striking him in the face with a pool cue and punching him in the mouth. The indictment also alleges that Nathaniel Swett intended to use a beer bottle as a dangerous instrument against a second individual.
The maximum possible sentence on the class D felony counts is seven years. The indictments resulted from an investigation conducted by the Seneca County Sheriff’s Department. Both defendants will be arraigned in Seneca County Court on November 26, 2012.
